Man who suits hospitals after he was told that he was alleged to be changed at birth

A New York man discovered that his mother and father were not his biological parents for 60 years after his birth, according to court documents obtained by humans.

Kevin McMahon, 64, brought an action against Jamaica Hospital Medical Center in Queens, NY, 2021, on an assertion of medical malpractice to change him at birth with Ross McMahon on May 26, 1960. Ross and Kevin were both tagged “Baby McMahon” Jery ​​and Kevin both told us. They were then said to be alleged to the incorrect set of parents.

Kevin learned his true identity after the woman he had grown up as his sister, Carol Vignola, 66, submitted her DNA to Ancestry.com in October 2020. Vignola was told about a biological brother, whom she was not aware of, according to the court documents.

The test results confirmed Vignola and Kevin’s long -term suspicions that he was not biologically related to his family. Vignola began to speculate if Kevin was her biological brother when she was 7 years old, she told New York Post.

Vignola then told her brother to the discovery, who was shocked by the revelation.

In January 2021, Kevin took up his own ancestry.com test, which confirmed his identity. He also discovered that he had a biological brother, Keith. Later, Kevin, Keith, Vignola and Ross took additional tests to confirm their genetic conditions.

“(It was) like a shock reaction. I literally could not meet the information,” Kevin told Post. “For a long time I’m like, I’m not really Kevin McMahon. I’m really Ross McMahon … I thought to myself:” I’m no one … I’m not there. “

Kevin told the outlet that during his childhood he was tormented by family members who suspected that he was not a blood -relative. “It was as it was missing the piece in the puzzle,” Kevin said. “(It) explained everything about why my childhood was as it was.”

He told me Post That his father’s grandmother and his father suspected that he was not related to them and treated him that way. Because of Kevin’s olive skin and brown eyes, his grandmother suspected that his mother had cheated on his father. “She seemed to hate me,” Kevin said. “She thought I wasn’t my father’s child and she was right.”

“I had some interactions with my grandmother who was abusive, physical abuse, and I learned to fear her and just stay away from her, really, stay out of reach,” Kevin said, leaving that he feared his late father.

“I was met a lot when I was little from my father, I didn’t look forward to him coming home,” he said. “I just thought my father didn’t really care about me,” Kevin added and said he was held “at the distance of the arm.”

All four parents involved died before the discovery was made.

Kevin also acknowledged that he has “a little jealous” for Ross. “They dotted him,” Kevin said. “My blood brother Keith tells me that my (biological) fatherly father was Ross’s biggest fan, that he supported him, always had his back, always was there. I would have loved to have it.”

Kevin is true for medical malpractice and claims that he “maintained negligent supply of emotional disorders”; “Serious mental disorder and emotional shock”; “Has been and continues to suffer from great emotional pain and anxiety”; and “has arisen and will continue to incur expenses for the care and treatment of his serious emotional injuries.” Kevin and his legal team seek unspecified financial damage.

“It makes them seem cold and heartless that they don’t even encounter and admit that this took place,” Kevin told Post by Jamaica Hospital.

“Two children. Same hospital. The same day. Same last name. Both tagged ‘Baby McMahon,'” His lawyer, Jeremy Schiowitz, told People. “Their birth certificate is sequentially. It’s not a mystery what happened – Jamaica Hospital changed children. And DNA proves it.”

Schiowitz told Post That the hospital failed to “double -check its procedures”, and added, “this was not a fluke. This was a preventive tragedy.”

Representatives of the Jamaica Hospital Medical Center did not give further comments when contacted on Monday.
