A woman was seriously injured after a burglary home with Beanie Babies Mogul for Warner.
Around 16:30 on Wednesday, May 21, alternates with Santa Barbara County Sheriff’s Office were called to Warner’s Montecito, CA home after a first report on a possible vehicle theft or ongoing home invasion.
When deputies responded to Fairway Road home, the 60-year-old Linda Malek-Aslanian found outside the home. The victim, which suffered serious injuries, was transported to a local hospital.
Warner was able to escape the housing and contact authorities.
“He was present,” Santa Barbara County district lawyer John Savrnoch tells People. “He was not physically injured. He could escape and contact the authorities.”
Deputies soon discovered that the suspect, Russell Maxwell Phay, 42, was still inside the home.
According to Santa Barbara Sheriff’s Office, alternates Phay discovered “Barricad” in an up -story toilet. Deputies tried to talk Phay out of the toilet, but he fled by climbing through the bathroom window. He was arrested by alternates and booked in Santa Barbara County’s main prison.
He has been accused of attempted murder with the first degree with premination and deliberation, burglary of housing with a person present and attack with a strength that is likely to cause great bodily injury and resist or delay a peace officer. He is also charged with kidnapping.
There is also a special accusation that personally adds great bodily harm “that causes the victim to become a comatos due to brain damage,” according to the charging document obtained by humans.
Why he is said to choose that the house is unclear.
“Right now I’m not sure,” Savrnoch says. “It’s a big house, but of course it’s in an area with many large houses.”
“We have no indication or believe that there was any connection” between the suspect and the victims, he says.
“It’s a very serious case,” Savrnoch says. “The injuries received by the victim, the charges themselves, attempted murder, housing burglary, present, abuse with a deadly weapon, kidnapping, they are all very serious accusations. We really pay a lot of attention to this case. And we will treat it as an incredibly serious case.”
